SessionGauge Private Beta Testing Agreement
This agreement is between Liquid Logic LLC (“Company”), the provider of SessionGauge, and the individual signing below (“Tester”).
1. Eligibility and voluntary participation
Participation is limited to residents of the United States who are at least 18 years old and legally able to enter this agreement.
The Tester voluntarily agrees to evaluate the private beta version of SessionGauge. Participation does not require using any substance, changing medications or treatment, taking health risks, or disclosing personal health information.
The Tester may stop participating at any time.
2. Permission to use the beta
The Company grants the Tester a limited, nonexclusive, nontransferable permission to install and use authorized SessionGauge beta builds for personal evaluation during the testing period.
The Tester must not distribute private installation files or access credentials, access another person’s records without permission, interfere with the service, or conduct security testing beyond separately authorized activities.
The Company retains ownership of SessionGauge and its software. The Tester retains ownership of the content they enter.
3. Pre release software and data risks
SessionGauge is pre-release software. Features may be incomplete, change, fail, or become unavailable. Errors may affect saving, syncing, reminders, exports, access, and data recovery.
A local save does not necessarily mean information has synced. Unsynced entries and changes may be permanently lost when local data is cleared or otherwise becomes unavailable.
The Tester should not use the beta as the only copy of important information or rely on it for safety-critical decisions. The Company does not promise a release date, continued availability, or that every reported issue will be corrected.
Report technical problems to [email protected]. Send suggestions and general testing feedback to [email protected].
4. Health and emergency limitations
SessionGauge is not a healthcare provider, emergency service, or substitute for professional medical advice. It does not diagnose, treat, prescribe, establish a safe dose, or guarantee that a substance or combination is safe.
Educational information may be incomplete or outdated. Records, summaries, reminders, and responder information may contain errors or omissions and are not independently verified medical records.
Do not delay seeking emergency assistance or professional care because of information in the app. SessionGauge does not guarantee detection of emergencies or automatic contact with emergency services or another person.
Testing results do not establish medical effectiveness or safety.
5. Privacy consent and testing records
The applicable privacy notices and separate in-app consent choices govern the collection and processing of personal information. This agreement does not replace those notices or authorize additional processing of sensitive information.
A document labeled as a draft is not made final by signing this agreement.
Use fictional information where practical when testing features. Do not enter another person’s sensitive information without appropriate permission.
Before sending screenshots, exports, logs, or bug reports, remove unnecessary personal information. Do not email passwords, access tokens, recovery codes, or other authentication secrets.
Signing this agreement does not authorize unrestricted access to the Tester’s device or private records. Any troubleshooting that requires access to private content must be separately explained and authorized.
Direct privacy questions and requests concerning access, correction, or deletion to [email protected]. Sending a request does not itself delete an account or its records.
6. Feedback
The Tester may voluntarily provide suggestions, observations, and bug reports.
The Tester grants the Company a nonexclusive, worldwide, royalty-free permission to use that feedback to evaluate, maintain, and improve SessionGauge. This permission does not transfer ownership of the Tester’s private records or authorize processing personal information for unrelated purposes.
The Company must obtain separate permission before using the Tester’s name, likeness, or private feedback as a public testimonial.
Participation does not create employment or an entitlement to payment. Any compensation must be agreed separately in writing.
7. Limited confidentiality
The Tester agrees not to distribute private beta installation files, access credentials, another person’s private information, or unpublished technical or business materials expressly identified as confidential.
This restriction does not cover information already public through lawful means, independently developed information, or information lawfully obtained from another source without a confidentiality duty.
Nothing in this agreement prohibits honest reviews, truthful descriptions of the Tester’s experience, obtaining legal or medical advice, reporting concerns to government authorities, legally protected disclosures, or disclosures required by law.
8. Security concerns
Report suspected vulnerabilities or unintended access to [email protected]. Provide only the information reasonably needed to explain the concern, with secrets and unnecessary personal information removed.
If the Tester unexpectedly encounters another person’s information, they should stop accessing it and report the issue without copying, changing, or distributing that information beyond what is legally permitted and necessary to report it.
This agreement does not authorize penetration testing, exploitation, disruption, or access to other accounts. Any such testing requires separate written authorization.
For suspected unauthorized activity involving the Tester’s own account, contact [email protected].
9. Leaving or ending the beta
The Tester may stop using SessionGauge or notify [email protected] that they wish to leave the beta.
Stopping participation, signing out, uninstalling the app, clearing local data, and deleting an account are different actions. Stopping participation does not automatically delete hosted records.
Account deletion and privacy requests remain subject to the applicable controls, notices, and legal requirements. Contact [email protected] for assistance.
The Company may suspend or end beta access for security, misuse, maintenance, or discontinuation of the testing program.
Provisions concerning ownership, permitted use of previously provided feedback, confidentiality, and rights that by their nature survive termination will continue to apply.
10. Warranty limitations and preserved rights
To the extent permitted by applicable law, the beta is provided “as is” and “as available,” without warranties of uninterrupted operation, accuracy, fitness for a particular purpose, or freedom from errors.
Nothing in this agreement excludes or limits rights, remedies, warranties, or liability that cannot lawfully be excluded or limited.
This agreement does not impose a monetary liability cap, an indemnification obligation, mandatory arbitration, or a class-action waiver.
11. Governing law and changes
This agreement is governed by Minnesota law and applicable federal law, without depriving the Tester of mandatory protections available under applicable law.
Questions about this agreement and legal notices should be sent to [email protected].
Material changes must be provided to the Tester for review and agreement before applying to continued participation. Changes do not retroactively authorize additional processing of sensitive information.
If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
This agreement governs beta participation. It does not override applicable privacy notices, separate consent choices, or mandatory legal rights.
12. Acknowledgment and signatures
By signing, the Tester confirms that:
- They are a United States resident, at least 18 years old, and legally able to enter this agreement.
- They have read this agreement and had an opportunity to ask questions.
- They understand the beta’s limitations and voluntarily agree to participate.
- Their signature is not a certification that SessionGauge is medically effective, safe, error-free, or fully tested.
- Their signature does not replace any separate consent required for processing sensitive information.
The parties may sign by hand or electronically where permitted by law. Each party will receive a copy of the completed agreement.
